STATEMENT OF CLAIM
Filed in the Brisbane Registry on: 17 July 2020.
This claim in this proceeding is made in reliance on the following facts
–
- The plaintiff is a company duly incorporated and having its registered office at 25
Currency Court, Brisbane in the State of Queensland. - The defendant is a natural person of female gender born 4 February 1937.
- On 21 January 2019, the plaintiff, through its associate Wayne Williams, entered
into a contract with the defendant for the defendant to purchase three million
dollars ($3,000,000.00) worth of gold bullion with a down payment of $100,000
(“the Contract”). - It was a term of the Contract that should there be a call on payment of amounts
outstanding, the defendant would make payment. - The defendant was warned that should the defendant fail or be unable to make payment when a call occurs, then:
(a) The defendant’s property (“the Property”) would be sold at 50% of its market value;
(b) The defendant will be required to vacate the Property immediately upon failure to make payment at call and would have no right, enforceable at law, to remain in possession; and
(c) The defendant would remain liable for any shortfall in the amount outstanding.
